On Monday, October 24, 2022, the U.S. Department of Justice announced charges against two Chinese nationals, who were accused of working to undermine the federal prosecution of the Chinese telecommunications company, HUAWEI.

He collection documents charged two citizens of the People's Republic of China (PRC) with two counts of money laundering and one count of obstructing an official proceeding, specifically interfering with the Eastern District of New York's (EDNY) pending prosecution of HUAWEI.

  • Gouchun Healso known as Dong He or Jacky He, and
  • King Zhengalso known as Zen Wang

The US Department of Justice called them intelligence officers of the People's Republic of China who conducted foreign intelligence operations directed at the United States, on behalf of the government of the People's Republic of China and for the benefit of Company-1 (HUAWEI).

How these Chinese spies were caught interfering in the HUAWEI case!

The US Justice Department's charging documents tell a truly compelling story of how the two Chinese spies were foiled by the very agent they recruited.

When the US Department of Justice ostensibly began its investigation into HUAWEI in 2017, Gouchun He and Zheng Wang recruited a US law enforcement official around February 2017. Unbeknownst to them, the official they recruited as their asset became a “double agent” for FBI oversight.

He and Wang began asking the official for confidential information about the US government's criminal case against HUAWEI, and received a payment in return:

  • approximately $14,000 in cash
  • Jewelry worth approximately $600
  • approximately $61,000 in Bitcoin

The official also received payments unrelated to this case (suggesting that He and Wang sought information about other cases):

  • $2,000 via Western Union
  • $3,000 in cash delivered in person by He and Wang
  • $9,000 in cash and jewelry

After the charges against HUAWEI were announced around January 2019, Gouchun He and Zheng Wang repeatedly asked their agent for secret information regarding HUAWEI's investigation and prosecution:

September 2021 : The official was asked to provide information about meetings with the U.S. Attorney's Office's EDNY prosecution team on strategizing for the jury trial.

October 2021 : In response to a request for documents, the official passed Gouchun He a document marked SECRET that purportedly purported to discuss a possible plan to charge and arrest two HUAWEI directors residing in China.

The official was paid $41,000 in Bitcoin for that single page, and then paid another $20,000 in Bitcoin the same month.

December 2021 : Gouchun told the official that HUAWEI “demanded to communicate with him/her directly,” but he/she allegedly “refused” because “it is too dangerous.”

The US official repeatedly indicated that he knew and expected that the materials he passed would be shared with HUAWEI, and Gouchun He and Zheng Wang never denied that they would share the documents or information with HUAWEI.

In fact, when the US official handed them the SECRET document, Gouchun He explained: “HUAWEI has not given me a specific answer (about the document) yet, but they are obviously interested in it and my friends and need more information.

Both Gouchun He and Zheng Wang then asked the US official for information about witnesses who were working with the US government to prosecute HUAWEI.
